Episode Background:

The keenly awaited hearing in front of Delhi High Court with respect to Anti-profiteering provisions has been deferred to 15th February, 2021, after multiple scheduled rounds planned in December, 2020 as well as January, 2021. Across industries, as many as 50 India Inc. have raised a challenge with respect to constitutional legitimacy of the anti-profiteering provisions under GST Act, 2017. The said hearing would surely be momentous since numerous judgments have been passed by the anti-profiteering authorities instructing companies to pass on the benefits to customers including levying raucous penalty.

Some of the burgeoning questions:

  • One of the most contentious aspects in this context is whether Section 171 is a perpetual section in law or not?
  • If business teams of companies need to bear in mind the implications of Section 171 always in addition to others pricing laws prevalent in India?
  • Whilst the third anniversary of GST has already been celebrated, would there be any further extension to the tenure of Anti-Profiteering authorities which was originally being introduced only for two years and further extended by another two years?
  • Will there be any further leeway to conclude the assessments under section 171 beyond 31st March, 2021?
