Categories: Other Laws
Publisher: Thomson Reuters South Asia Private Limited
About Book:

Dharmoprudence strives to examine in depth the use, utility and relevance of the Indian concept of dharma, conceded as the science of sciences, the art of arts and the knowledge of knowledge. Dharmoprudence is about the precepts of Indic Prudentia Juris that denotes law-making or legal practices, Vidhi, Nyaya and Niti Padhati, which enhance the jurisprudence practices assimilated and disseminated by ancient Indian wisdom, insight, perception, astuteness, intelligence, acumen, judgment and understanding and their relevance to the advancement of societal transformation in good administration and in the administration of justice in the new millennia of constitutional democracy. Dharma is the foundational fundamental (Dhri) of Vidhi and Nyaya and as such the basic structure of Dharmoprudence. It ought to be an exertion to transform Indic Jurisprudence professed to be the real Fons Juris of the socio-legal-cultural heritage of India, since Dharma as the law of life regulates the relationships between the State and the citizens through Rajdharma (law of the constitution), Rajyadharma (law of administration) and Rajyasasna (rule in accordance with the principles of statecraft). Thus, it is the basis for the evolution of Prudentia Juris of Dharma as well as Nyaya, perhaps the most beautiful works of the literature of the world, ocean of milk, the cradle of humanity, and a law of life for blissful statecraft that shall be the advancement of Indic Prudentia Juris, viz., a legal science of India of Indian origin. Let us revisit by submitting that positive law, in fact, cannot survive without therapy of the Dharma Trimurti—three manifestations—of Vidhi, Nyaya and Niti Padhati.
