The Finance Minister presented the Union Budget, 2021, which has been hailed by the industry as a “never before” budget providing a fillip to business sentiments by and large. However, as they say, the devil lies in the details. One important change which emerged from the budget document was the proposed amendments to provisions relating to the Equalisation Levy (EL) expanding the scope of EL for foreign enterprises on offshore sale of good and services to customers in India (which is not effectively connected to PE in India).
The Finance Minister made two inconsequential amendments in the provisions of EL at the stage of enactment on March 23, without addressing the aforesaid concerns, which has left the industry /foreign enterprises grappling with the wider implications of EL.
