The Supreme Court Ruling on Prevention of Money Laundering Act, 2002 (PMLA) provisions inter alia upheld the Enforcement Directorate’s powers relating to arrest, attachment of property, search and seizure under the PMLA, thereby rejecting almost all the arguments put forth by the Petitioners, challenging the constitutional validity of these provisions. The Top Court held that none of the provisions challenged therein, were arbitrary or suffered from the vice of unreasonableness. The 3-Judge Bench emphasized that the PMLA was enacted to address the urgent need to have a comprehensive legislation for preventing money-laundering, owing to the serious threat to the financial system of the country.
