In this regard, with respect to share issuances by such Indian companies to investors; it is important to ensure that such share issuance is in compliance with the prescribed tax valuation norms that apply from both the issuing company and the investor’s perspective. The Union Budget 2023 proposes to expand the scope of the “angel tax” provisions (currently applicable in case of share issuances by an Indian company to resident investors) to issuances made to non-residents as well.
