Issues concerning receipt and utilization of foreign contribution have been a matter of major concern for the Government in the present times. Having regard to the same, the Foreign Contribution (Regulation) Act, 2010 has recently been amended by FC(R) (Amendment) Act, 2020 and the FC(R) Rules, 2011 by the FC(R) (Amendment) Rules, 2020. The changes brought about relate to electronic methods of communication with the Government, provisions have been made more stringent, there is an increase in the fees payable under the Act, organizations are required to have a standing of three years and have spent at least Rupees fifteen lakhs for the benefit of society during three years, public servants have been brought under the Act, there is an absolute prohibition on transfer of funds to other persons, there is a limit of twenty percent every year on administrative expenses, an FCRA Account has to be opened in the State Bank of India, New Delhi or in any of its branches, there is a requirement of Aadhar Card as an identification document, new provision for summary inquiry in cases of contravention of the provisions of the Act. Consequently the FC(R) Rules 2011 have been amended to conform to the changes made in the Act. Besides, the Forms FC-1 to FC-7 have been substituted.
All these amendments have necessitated bringing out of the present seventh edition of the book duly revised in the context of the amendments. It is hoped that this revised edition will give proper insight and guidance to the readers.
