The proposed book on Wills, Nomination & Succession is an effort to provide the required information which a succession planner needs to have. Since the law of succession is complicated as there are different laws dealing with the subject, the authors have made an attempt to make the subject concise simple and understandable, to the extent possible. Separate chapters discuss the intestate succession laws in case of Hindus, Muslims, and for persons other than Hindus and Muslims. A separate section of the book is devoted to the discussion of Testamentary Succession. Provisions relating to Probate, Letters of Administration and Nominations are discussed separately. The book serves as a practical guide for writing a valid Will and precautions to be taken in the matter so as to minimize the possibility of challenge. The book attempts to explain the basic provisions of the Income Tax Act which can impact the decision making process while making a Will. The book also discusses the concept of a ‘Living Will’, as to how the ultimate view evolved, how such a Will can be executed and how, if the contingency arises, the same is to be given effect to. The chapters relating to the substantive laws are supported by the specimen documents given in the Appendices.
