Indian Art consists of a variety of art forms, be it paintings, sculptures, pottery, textile arts, etc. Speaking of art, recently the Maharashtra AAR examined an issue where the applicant [TS(DB)-GST-AAR(MAH)-2022-349] is in the business of procuring paintings on an approval basis from unregistered and registered persons and sells them by auction to the highest bidder. In this case, the AAR ruled that second hand or used ‘Paintings’ are classifiable under Heading 9701, and for the payment of tax on the sale of such Paintings, the Applicant can apply Rule 32(5) of the CGST Rules.

As the government strives to develop the law in order to make it litigation-free, it becomes necessary for a professional to stay updated and aligned with all the changes occurring in the GST world.
