Over the past couple of months, the GST landscape has witnessed a lot of action! Sample this - last week, FinMin notified State Benches of GST Tribunal at 36 locations; next, the CBIC laid down the procedure for cases where provisional attachment of property ceased to have effect; thirdly, the August GST Collections at Rs. 1.59 lakh cr., recorded a 11% YoY growth & much more. From a litigation standpoint, Patna HC issued a series of judgments, be it coming down heavily on an Assessing Officer for surreptitiously making the recovery of the entire amounts due as tax, interest and penalty, contrary to the legislative mandate as envisaged under GST enactment [TS(DB)-GST-HC(PAT)-2023-782]; to upholding denial of ITC benefit to purchasing dealer (assessee) where the supplying/selling dealer has not paid up the amounts to the Government, despite collection of tax from the purchasing dealer [TS(DB)-GST-HC(PAT)-2023-738]; to upholding validity of Section 16(4) denying ITC for belated return-filing [TS(DB)-GST-HC(PAT)-2023-842].

As the government strives to develop the law in order to make it litigation-free, it becomes necessary for a professional to stay updated and aligned with all the changes occurring in the GST world.
