Categories: GST & Other Indirect Taxes
Publisher: Bharat Law House Pvt Ltd
About Book:

GST has been the biggest tax reform the Country has seen in the last 5 to 6 decades. Implementation of such a large-scale tax reform in a country like India has its own set of challenges. Many of the sectoral challenges in the erstwhile indirect tax regime continue even under the GST regime and in certain cases, new challenges have emerged. Each Sector has its own set of unique challenges under GST, be it classification, levy or any other core area, which needs in depth introspection. The book  encompasses a comprehensive commentary on various GST implications for the Healthcare and Pharma Sector.

The book is primarily covered in three parts, with specific focus on providing in-depth coverage and insights of the authors. Part A covers the Healthcare service sector and the allied services which are provided under this Sector. It begins with an evaluation of the sector under the erstwhile indirect tax regime and discussions covering various judicial precedents, which builds the foundation for the reader for better understanding of the parallel implications under GST. Part B discusses the Pharma sector with the help of an exhaustive commentary on the issue - how one should determine the classification, with reference to various judicial precedents and how Courts have dealt with the said issue? The author provides the readers with a comprehensive commentary on all possible streams of income and the corresponding implications under GST. Part C gives an overview on the provisions of the GST law, to the extent the same are applicable for the Sector at large ( Healthcare and Pharma) and also covers applicable provisions of allied laws including the Customs Act and the Foreign Trade Policy.
