The Hon'ble Supreme Court delivered a historic verdict this week in the case of Union of India v. Ashish Agarwal & Others [TS-339-SC-2022] and settled the monumental controversy surrounding over 90,000 reassessment notices. The Supreme Court performed an Augean task of striking a balance between Revenue's right to reassess and the avowed rights of the Assessees to bring an end to the uncertainty looming over the taxpayers and the exchequer alike. In order to put the controversy to rest, once and for all, the Supreme Court invoked its extraordinary powers under Article 142 of the Constitution and modified all the High Court judgments where reassessment notices issued under the old regime were quashed.
