On the international front, MLI has become a reality in India from 1st April 2020, whereby India's Covered Tax Agreements (CTAs) would get modified in respect of those treaties where the respective treaty partners have notified for matching options. It is critical to understand how MLI interfaces with existing CTAs and how it operates alongside the CTA. While Treaty partners are at liberty to bilaterally make amendments to the CTA at a future date, whether this new approach of treaty interpretation would result in any issues and controversies is a consequence we need to wait and watch. Thus, this topic needs an intense deliberation.

On the domestic front, Finance Act 2023 made an amendment to Section 56(2)(viib) [dubbed as "Angel Tax"] of Income Tax Act, so as to bring non-resident investors under the ambit of this provision. CBDT came out with a press release on 19th May 2023 and a notification dated 24th May 2023 proposing changes in Rule 11UA with respect to valuation and also notified some excluded entities from the coverage of this amendment. However, the startup industry is not fully satisfied as of now, and thus this development requires an in-depth discussion for the benefit of various stakeholders.
